Social network targeted legislators around the world, promising or threatening to withhold investment<\/div>\n<\/div>\n<\/div>\n

Facebook has targeted politicians around the world \u2013 including the former UK chancellor, George Osborne \u2013 promising investments and incentives while seeking to pressure them into lobbying on Facebook\u2019s behalf against data privacy legislation, an explosive new leak of internal\u00a0Facebook<\/a>documents has revealed.<\/p>\n

The documents, which have been seen by the\u00a0Observer<\/em>\u00a0and\u00a0Computer Weekly<\/a><\/em>, reveal a secretive global lobbying operation targeting hundreds of legislators and regulators in an attempt to procure influence across the world, including in the UK, US, Canada, India, Vietnam, Argentina, Brazil, Malaysia and all 28 states of the EU. The documents include details of how Facebook:<\/p>\n

\u2022<\/span>\u00a0Lobbied politicians across Europe in a strategic operation to head off \u201coverly restrictive\u201d\u00a0GDPR<\/a>\u00a0legislation. They include extraordinary claims that the Irish prime minister said his country could exercise significant influence as president of the EU, promoting Facebook\u2019s interests even though technically it was supposed to remain neutral.<\/p>\n

\u2022<\/span>\u00a0Used chief operating officer Sheryl Sandberg\u2019s feminist memoir\u00a0Lean In<\/em>\u00a0to \u201cbond\u201d with female European commissioners it viewed as hostile.<\/p>\n

\u2022<\/span>\u00a0Threatened to withhold investment from countries unless they supported or passed Facebook-friendly laws.<\/p>\n

The documents appear to emanate from a court case against Facebook by the app developer Six4Three in California, and reveal that Sandberg considered European data protection legislation a \u201ccritical\u201d threat to the company. A memo written after the Davos economic summit in 2013 quotes Sandberg describing the \u201cuphill battle\u201d the company faced in Europe on the \u201cdata and privacy front\u201d and its \u201ccritical\u201d efforts to head off \u201coverly prescriptive new laws\u201d.<\/p>\n

Most revealingly, it includes details of the company\u2019s \u201cgreat relationship\u201d with\u00a0Enda Kenny<\/a>, the Irish prime minister at the time, one of a number of people it describes as \u201cfriends of Facebook\u201d. Ireland plays a key role in regulating technology companies in Europe because its data protection commissioner acts for all 28 member states. The memo has inflamed data protection advocates, who have long complained about the company\u2019s \u201ccosy\u201d relationship with the Irish government.<\/p>\n

The memo notes Kenny\u2019s \u201cappreciation\u201d for Facebook\u2019s decision to locate its headquarters in Dublin and points out that the new proposed data protection legislation was a \u201cthreat to jobs, innovation and economic growth in Europe\u201d. It then goes on to say that Ireland is poised to take on the presidency of the EU and therefore has the \u201copportunity to influence the European Data Directive decisions\u201d. It makes the extraordinary claim that Kenny offered to use the \u201csignificant influence\u201d of the EU presidency as a means of influencing other EU member states \u201ceven though technically\u00a0Ireland<\/a>\u00a0is supposed to remain neutral in this role\u201d.<\/p>\n

It goes on: \u201cThe prime minister committed to using their EU presidency to achieve a positive outcome on the directive.\u201d Kenny, who resigned from office in 2017, did not respond to the\u00a0Observer<\/em>\u2019s request for comment.<\/p>\n

John Naughton, a Cambridge academic and\u00a0Observer<\/em>\u00a0writer who studies the democratic implications of digital technology, said the leak was \u201cexplosive\u201d in the way it revealed the \u201cvassalage\u201d of the Irish state to the big tech companies. Ireland had welcomed the companies, he noted, but became \u201ccaught between a rock and a hard place\u201d. \u201cIts leading politicians apparently saw themselves as covert lobbyists for a data monster.\u201d<\/p>\n

A spokesperson for Facebook said the documents were still under seal in a Californian court and it could not respond to them in any detail: \u201cLike the other documents that were cherrypicked and released in violation of a court order last year, these by design tell one side of a story and omit important context.\u201d<\/p>\n

The 2013 memo, written by Marne Levine, who is now a Facebook senior executive, was cc-ed to Elliot Schrage, Facebook\u2019s then head of policy and global communications, the role now occupied by Nick Clegg. As well as Kenny, dozens of other politicians, US senators and European commissioners are mentioned by name, including then Indian president Pranab Mukherjee, Michel Barnier, now the EU\u2019s Brexit negotiator, and Osborne.<\/p>\n

The then chancellor used the meeting with Sandberg to ask Facebook to invest in the government\u2019s Tech City venture, the memo claims, and Sandberg said she would \u201creview\u201d any proposal. In exchange, she asked him to become \u201ceven more active and vocal in the European Data Directive debate and really help shape the proposals\u201d. The memo claims Osborne asked for a detailed briefing and said he would \u201cfigure out how to get more involved\u201d. He offered to host a launch for Sandberg\u2019s book in Downing Street, an event that went ahead in spring 2013.<\/p>\n

Osborne told the\u00a0Observer<\/em>: \u201cI don\u2019t think it\u2019s a surprise that the UK chancellor would meet the chief operating officer of one of the world\u2019s largest companies \u2026 Facebook and other US tech firms, in private, as in public, raised concerns about the proposed European Data Directive. To your specific inquiry, I didn\u2019t follow up on those concerns, or lobby the EU, because I didn\u2019t agree with them.\u201d<\/p>\n

He noted it was \u201cnot a secret\u201d that he had helped launch Sandberg\u2019s book at 11 Downing Street and added: \u201cThe book\u2019s message about female empowerment was widely praised, not least in the\u00a0Guardian<\/em>\u00a0and the\u00a0Observer<\/em>.\u201d<\/p>\n

In fact, the memo reveals that Sandberg\u2019s feminist memoir was perceived as a lobbying tool by the Facebook team and a means of winning support from female legislators for Facebook\u2019s wider agenda.<\/p>\n

In a particularly revealing account of a meeting with Viviane Reding, the influential European commissioner for justice, fundamental rights and citizenship, the memo notes her key role as \u201cthe architect of the European Data Directive\u201d and describes the company\u2019s \u201cdifficult\u201d relationship with her owing to her being, it claims, \u201cnot a fan\u201d of American companies.<\/p>\n

\u201cShe attended Sheryl\u2019s\u00a0Lean In<\/em>\u00a0dinner and we met with her right afterwards,\u201d the memo says, but notes that she felt it was a \u201cvery \u2018American\u2019 discussion\u201d, a comment the team regarded as a setback since \u201cgetting more women into C-level jobs and on boards was supposed to be how they bonded, and it backfired a bit\u201d.<\/p>\n

The Davos meetings are just the tip of the iceberg in terms of Facebook\u2019s global efforts to win influence. The documents reveals how in Canada and Malaysia it used the promise of siting a new data centre with the prospect of job creation to win legislative guarantees. When the Canadians hesitated over granting the concession Facebook wanted, the memo notes: \u201cSheryl took a firm approach and outlined that a decision on the data center was imminent. She emphasized that if we could not get comfort from the Canadian government on the jurisdiction issue, we had other options.\u201d The minister supplied the agreement Facebook required by the end of the day, it notes.<\/p>\n<\/div>\n<\/div>\n
